cliff deal in washington. the dow jones industrial average gained more than 82 points to close at 13,034. but the nasdaq fell nearly 23 points to close at 2,973. the day's big loser was apple, down more than 6% over concerns that smart phone sales are lagging. former texas congressman jack brooks has died. he served 42 years in the house, and was in the dallas motorcade on november 22nd, 1963 when president kennedy was assassinated. hours later, brooks was on hand as vice president and fellow texan lyndon johnson was sworn in to the presidency. later, brooks helped author the 1964 civil rights act, and he drafted the articles of impeachment against president nixon. jack brooks was 89 years old. those are some of the day's major stories. now, back to gwen. >> ifill: lawmakers stepped up the rhetoric, but grew no closer today to agreement on how to avoid slipping over the so- called fiscal cliff. but each side demanded the other compromise. you back to the negotiations over the fiscal cliff. and i think this raises the pressure to get a deal done. that's important. and the part of the deal that is actually not being talked about, but which will be central, is the spending side. the sequester is a very bad policy. both sides agree it needs to go away. they have to figure out how. and the tax side has to be matched by entitlent reforms, and you can pick 37 if you have the right entitlement reforms, but only 36 if you have less and you could get 38 if you have more. there's a lot of work left to be done. >> let's talk about that, robert. on the spending side. do you think that there's any way the democrats get out of this over the next 18 or 24 months without really addressing spending and probably annoying a lot of their base in the process? >> well, the president has already put a lot of spending cuts on the table. let me partially agree with doug. the employment report today was, although it looked pretty encouraging if you look at the numbers underneath the numbers, it was not all that encouraging. the labor force partic

a deal on the fiscal cliff or else automatic spending cuts and tax hikes will kick in and with the fiscal cliff looming, our consumers feeling at all concerned? christine romans joins us now from new york with that. good morning, christine. >> good morning, ted. first, let me tell you what's going right in the economy for consumers. there's a whole host of things. the job markets, 7.7% unemployment, the lowest in four years. you've got the housing market showing signs of recovery. rising home values in much of the country. gas prices, did you notice? they're down 46 cents over the past couple of months. they're expected to keep going lower and the dow is up 20 points now. the dow is above 1,300 and the s&p 500 is up 12% this year. so, what could go wrong? fiscal cliff. this is something weighing op consumer sentiment and we're starting to see it in the weekly -- look at this -- 39% said it would affect it some. they don't seem to have much faith in congress to fix it and any time except 11th hour and maybe a week into the new year and there's this payroll tax holiday that most people have

meaningful conversations in a variety of subjects. i was going to deal with that problem with the fiscal cliff today, but gun violence is another area in america where it seems we can't have a discussion without delusional claims of overreach and taking away hunting rifles. congress won't even allow statistics on gun violence to be gathered, and we certainly have made no progress towards closing the gun show loophole. i come to the floor with a small array of hope. with nearly half of all military sue sides are committed with privately owned weapons, the pentagon and congress are moving towards establishing policies to separate at-risk service members from personal private weapons. congress is poised to enact legislation to end a prohibition about the military collecting information about firearms kept at home. these are simple commonsense steps for an armed services where more military personnel take their own life than who die in battle. perhaps if we can take these reasonable steps to protect our servicemen and their families, perhaps we can have the courage to treat the epidemic of g

and counting until the nation falls off the fiscal cliff. president obama and house speaker boehner are going on with negotiations. >> we had another week of massive trash-talking, are we closer or further away from getting a deal? >> they're not really talking right now. that's what's most incredible. there were speeches all week long. lot of ads on television. less than an hour of negotiations. one-hour phone call between to president obama and house speaker boehner. democrats say they're not going to move until the republicans say they're going to be for higher tax rates on the wealthy. and spending cuts. republicans aren't going to come forward until the democrats say more about how they want to cut spending. right now, we're stuck. now, it could be the well that is getting poisoned right now, as positions are going to harden with all of these negotiations they sometimes with most fire before they break. the debt limit, president obama said that he's not going to negotiate at all over the debt limit. i don't know how you can get that resolved by december 31st. >> could the republicans giv
